LIMITATION OF LIABILITY
Great care has been taken to ensure that the information available on this website/ mobile application is correct and error free. We apologize for any errors or omissions that may have occurred. We cannot warrant that use of the website will be error free or fit for purpose, timely, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website and we do not make any warranty whatsoever, whether express or implied, relating to fitness for purpose, or accuracy.

By accepting these terms of use you agree to relieve us from any liability whatsoever arising from your use of information from any third party, or your use of any third party website, or your consumption of any Goods / Products from us.

We disclaim any and all liability to you for the supply of the Service Delivery, Food items, Goods and Services to the fullest extent permissible under applicable law. This does not affect your statutory rights as a consumer. If we are found liable for any loss or damage to you such liability is limited to the amount you have paid for the relevant Goods or Services. We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits to you, howsoever arising. This limitation of liability does not apply to personal injury or death arising as a direct result of our negligence.

We do not accept any liability for any delays, failures, errors or omissions or loss of transmitted information, viruses or other contamination or destructive properties transmitted to you or your computer system via our website.

We shall not be held liable for any failure or delay in performing Services or delivering food items and  goods where such failure arises as a result of any act or omission, which is outside our reasonable control such as all overwhelming and unpreventable events caused directly and exclusively by forces of nature that can be neither anticipated, nor controlled, nor prevented by the exercise of prudence, diligence, and care, including but not limited to: war, riot, civil commotion; compliance with any law or governmental order, rule, regulation or direction and acts of third parties.

If we have contracted to provide identical or similar order to more than one Customer and are prevented from fully meeting our obligations to you by reason of an Event of Force Majeure, we may decide at our absolute discretion which orders we & the participating chefs will fill and to what extent.

The products sold by us are provided for private domestic and consumer use only.

We have taken all reasonable steps to prevent Internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers or those of third parties.

In the event Arogyaa has a reasonable belief that there exists an abuse of vouchers and/or discount/referral codes or in suspected instances of fraud, Arogyaa may cause the shopper (or customer) to be blocked immediately and reserves the right to refuse future service. Additionally, should there exist an abuse of vouchers or discount codes, Arogya reserves the right to seek compensation from any and all violators.

The vouchers/discount/credit calculation is subject to Arogyaa’s discretion and may be altered / withdrawn at any time and without notice. This can discount any/all of the components including goods/services cost, taxes and fees and likewise.

All prices are indicated in INR. Prices are inclusive of taxes unless otherwise indicated

We may subcontract any part or parts of the Services or Goods that we provide to you from time to time and we may assign or negate any part or parts of our rights under these Terms and Conditions without your consent or any requirement to notify you.

We may alter or vary the Terms and Conditions at any time without notice to you.

Do not use or launch any automated system or program in connection with our website or its online ordering functionality.

Do not collect or harvest any personally identifiable information from the website, use communication systems provided by the website for any commercial solicitation purposes, solicit for any reason whatsoever any users of the website with respect to their submissions to the website, or publish or distribute any vouchers or codes in connection with the website, or scrape or hack the website.

Payment must be made either at the time of placing the order by credit card or at the time of delivery by cash. Failure to pay on time will result in the cancellation of your order

It may be noted by the customer that once registered he/she will be receiving all kinds of promotional SMS, mailers and notifications to keep him/her updated with our offers and other forms of information.

The Terms and Conditions together with the Privacy Policy, any order form and payment instructions constitute the entire agreement between you and us. No other terms whether expressed or implied shall form part of this Agreement. In the event of any conflict between these Terms and Conditions and any other term or provision on the Website, these Terms and Conditions shall prevail.

If any term or condition of our Agreement shall be deemed invalid, illegal or unenforceable, the parties hereby agree that such term or condition shall be deemed to be deleted and the remainder of the Agreement shall continue in force without such term or condition.

These Terms and Conditions and our Agreement shall be governed by and construed in accordance with the Laws of India. The parties hereto submit to the exclusive jurisdiction of the courts of India.

No delay or failure on our part to enforce our rights or remedies under the Agreement shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.

These Terms and Conditions and a contract (and all non-contractual obligations arising out of or connected to them) shall be governed and construed in accordance with India Laws. Both we and you hereby submit to the non-exclusive jurisdiction of the India Courts. All dealings, correspondence and contacts between us shall be made or conducted in the English language.

PROMOTIONS
From time to time Arogyaa will run promotional offers on its platforms in the form of vouchers and discounts that can be applied to user accounts. Promotions that are offered as valid for new customers only may not be applied to existing accounts or individuals who already have anArogyaa account, whether active or dormant. In all cases promotional vouchers cannot be transferred to other users. Vouchers may only be redeemed against the purchase of services on the Arogyaa platforms.

Data collection and uses

Arogyaa collects the following:

Data provided by users to Arogyaa, such as those generated during account creation

Data created during the use of our services, such as details of the device, location and use of the app

Data from other sources, such as Arogyaa Partners or third parties that use the Arogyaa APIs

The following information is collected by or on behalf of Arogyaa:

1. Data provided by users. This includes the following:

User profile: We collect the data generated when users create or update their Arogyaa accounts, which may include their name, email, phone number, username and password, address, profile picture, payment or bank details ( including your checkup). It also includes vehicle or insurance information for Drivers and Delivery Partners, and user settings. We may use the photos sent by the Drivers or Delivery Partners to verify their identities, using technologies such as facial recognition. To learn more, see the section How we use personal data.

User Content: We collect information that users submit when they contact Arogyaa customer support, give ratings or recognition to other users or Partner Restaurants, or contact Arogyaa in some other way. This may include comments, photos, or other recordings collected by users.

2. Data created during the use of our services. This includes the following:

Location data: If the user allows it, we collect accurate or approximate location data from your mobile device. In the case of Driver Partners and Delivery Partners, Arogyaa collects this information when the Arogyaa app runs in the foreground (open app and on screen) or in the background (open app, but not on screen) of your device mobile. In the case of users, clients and tenants, Arogyaa collects this data when the Arogyaa app is running in the foreground and in the background when the app is open but not on the screen. Users, customers and tenants can use Arogyaa apps without allowing location data to be collected from their mobile devices. However, this may affect some available functions. For example, if a user does not allow location data to be collected, they will need to manually enter the point for it. In addition, the location data collected from a Member during a trip will be linked to the user’s or renter’s account, even if they did not allow it to be collected, to generate receipts, provide customer support, detect fraud, and for insurers and litigation.

Usage data: We collect information about how users interact with our services, such as the date and time of access, app functions or pages viewed, app failures and other system activities, browser type, and sites or services. used before interacting with our services. In some cases, we collect this data through cookies, pixels, tags, and similar technologies that create and maintain unique identifiers. To learn more about these technologies.

Device Data: We may collect data about the devices used to access our services, including hardware models, IP address, operating systems and versions, software, preferred languages, unique device identifiers, advertising identifiers, serial numbers, and information on the movement of the device or mobile networks.

Communication data: We allow users to communicate with each other and with Arogyaa through Arogyaa’s mobile apps and websites. For example, we allow communication between Driver Partners and users, and between restaurants or Delivery Partners and customers through calls, SMS, or other files (generally without disclosing their phone numbers). To provide this service, Arogyaa receives certain data related to calls, SMS or other communications, such as their date, time and content. Arogyaa may also use this information to provide customer support services (including to resolve disputes between users), for security purposes, to improve our products and services, and for analysis.

3. Data from other sources. This includes the following:

User comments, such as ratings, opinions, or acknowledgments.

Users or other people who provide data in relation to claims or conflicts.

Arogyaa business partners through whom users create or access their Arogyaa account, such as payment providers, social networking services, or apps or websites that use Arogyaa’s APIs or whose APIs Arogyaa uses.

Publicly available sources.

Marketing service providers.

Arogyaa may combine the information collected from these sources with other data it may have.

B. How we use personal data

Arogyaa collects and uses information to provide reliable and convenient delivery services, as well as to offer other products and services. We also use the collected data to do the following:

Improve the security of users and services

Provide customer support

Carry out research and development tasks

Allow communication between users

Send marketing and other communications to users

Address issues related to legal proceedings

Arogyaa does not sell or disclose personal user data to third parties for direct marketing purposes, unless the users give their consent.

Arogyaa uses the information collected for the following purposes:

1. Provide services and functions. Arogyaa uses the collected data to provide, personalize, maintain and improve our products and services.

This includes using them for the following:

Create and update user accounts.

Allow transportation, delivery and other services.

Offer, process or facilitate payments for our services.

Track and share travel or delivery progress.

Activate functions that allow users to share information with other people, for example, when customers make comments about a restaurant or a Delivery Partner, or when users send an acknowledgment to a Delivery Partner, refer a friend to Arogyaa.

Activate features to customize users’ Arogyaa accounts, such as bookmarking favorite locations, and allowing quick access to previous destinations. For example, we may provide a Arogyaa user with personalized restaurant or meal recommendations based on their previous orders. See the Options and transparency section of this notice to learn how to oppose this use of personal data.

Activate the Accessibility functions that facilitate the use of our services by users with disabilities, such as those that allow Driver Members with hearing disabilities or with hearing difficulties to inform users about their condition, activate only the SMS of the users and receive flashing notifications, instead of audible, for travel requests on their mobile device.

Perform internal operations necessary to provide our services, including troubleshooting software bugs and operational problems, conducting analysis, testing, and research, and tracking and analyzing usage trends and activities.

2. Security. We use personal data to maintain the security and integrity of our services and users. This includes the following:

Perform the selection process for users, Drivers and Delivery Partners before allowing them to use our services and at intervals thereafter, including during background check reviews, when permitted by law, to prevent untrustworthy persons from using our services.

Use data from Driver or Delivery Partner devices to identify unsafe driving behaviors, such as speeding, or sudden braking and acceleration, and inform them of safer practices. We also use information from Delivery Partner devices to verify the type of vehicle they used to make deliveries.

Use device, location, profile and usage data, among others, to prevent, detect and combat fraud or unsafe activities.

Use user ratings and comments to encourage adherence to our Community Guidelines and as a reason to deactivate Driver Partner and Delivery Partner accounts that are poorly rated or otherwise violate these guidelines in certain countries.

3. Research and development. We may use the data we collect for testing, research, analysis, product development, and machine learning in order to improve the user experience. This helps us improve the security of our services, as well as prevent their use for illegal or improper purposes, develop new features and products, and facilitate insurance and financial proposals related to our services.

5. Allow communications between users. For example, a Driving Partner can send an SMS or call a user to confirm a starting point, a user can contact a Driving Partner to retrieve a forgotten item, or a restaurant or Delivery Partner can call a customer to provide information about your order.

6. Marketing. Arogyaa may use the collected data to market our services to users. This includes sending communications to users about Arogyaa’s services, features, promos, sweepstakes, studies, surveys, news, updates, and events.

We may also send communications to our users about the products and services offered by Arogyaa Partners. For example, if a user places an order through the Arogyaa Eats app, we may provide suggestions, promotions or advertisements for similar meals from other Arogyaa Partners. Although we may send communications to users about Arogyaa Partners ‘products and services, we do not sell users’ personal data or share it with such Partners or others for direct marketing purposes, unless the users give their consent.

We may use the data we collect to personalize the marketing communications we send (including advertisements), including based on location, previous use of Arogyaa services, and user preferences and settings.

We may also send communications to users about elections, voting, referendums, and other political and notice processes related to our services. For example, Arogyaa notified some users by email about voting measures or pending laws related to the availability of Arogyaa services in their areas.

7. Non-commercial communications. Arogyaa may use the data we collect to generate and provide user receipts, inform them of changes to our terms, services, or policies, or send other communications that are not intended to market Arogyaa or its services or products. Partners

Deactivation of the accounts of those users involved in cases of fraud or in activities that, in any way, could damage Arogyaa, its users and third parties. For example, in some cases, a user may be automatically deactivated if it is determined that he is abusing the Arogyaa referral program.
